How to Prevent and Answer RFEs and Denials for Wrong Degree Specialization

How to Prevent and Answer RFEs and Denials for Wrong Degree Specialization
Employers commonly hire employees with degrees in fields related to the industry because of the high degree of skillset and knowledgebase overlap. However, USCIS will not approve these visas outright.

For nearly a decade, USCIS has been denying or issuing RFEs for the H-1B visas of applicants that have the right degree in the wrong specialization – even if it is a related specialization. This becomes a common problem from H-1B applicants because often they are hired to positions in specialized fields related to their degree major. To prevent education issue RFEs and Denial for this, the best measure to take is to get a credential evaluation that closes any gaps between the degree and the job title.

This evaluation should be written by a professor with the authority to issue college credit for work experience. That way, every three years of progressive work experience in the field of the H-1B job can be converted into one year of college credit in the major that matches the industry of the H-1B job. This evaluation should also take all courses in the field of the H-1B job into consideration to count towards a major in that field.

If your employee or client has already received an RFE or Denial for a mismatched degree specialization issue, including this credential evaluation in the response works to get it overturned and the visa approved.

At CCI, www.ccifree.com, we work with professors to write credential evaluations tailored to the applicant, the  education,  the  job,  and  USCIS  approval  trends.  Each  evaluation  must  be  uniquely  written  to  successfully  prevent or overturn these RFE and Denial issues.

We are also starting a new PRIVATE  Facebook group of attorneys and employers to discuss RFE strategies with each other.
