Attention Business Owners- Tax Incentive

Hi Esther,


I hope this email finds you well, and I will be to the point.


As a CPA, I am seeing A LOT of bogus marketing regarding the ERC Program. As you may or may not know, the Employee Retention Tax Credit (ERTC) Program, per the IRS definition, was pass by Congress as part of the Cares Act.


For companies who retained 500 or less W2 employees in the years of 2020 and/or 2021, this tax credit is issued in the form of a check, from the IRS to your company, up to $26k per employee.


This IS NOT a loan. This is a tax incentive just like other tax incentives for business owners.


Now, I have seen companies charging high rates (20% plus) to prepare and file a company's amended 941's.


That is not only a ridiculous rate, but a sign of who is preparing your 941's.


CPA's ARE NOT permitted to prepare works on a contingency basis.


Yet , companies CLAIMING to help you do exactly this, which means there is NO CPA behind the preparation.


So who is preparing?


Some self-proclaimed expert?


Long story short, these are nothing but marketing companies with sales reps who are looking to make a quick buck and run. They could care less about the client. They offer no protection on filing while charging enormous rates on YOUR money. And be careful for those who tell you why audit protection is not needed...


As a CPA of 25+ years, I work with clients direct in determining if they qualify. If they do, and we agree to work together, fees normally total on an average 0f 14% and are value based; to include rapid filing and audit protection.

We are seeing the average of other companies between 20-25%, and only one at 15%, but they do not offer Audit Protection.


The fact is many of these large companies who reach out to help with ERC are simply a marketing and sales company with little, if any, CPA's in the backing that you can speak with regarding your specific reason for filing.

🚨 Know the Facts: The Employee Retention Credit (ERC)

I hope you've been well.


I'm curious if you've looked into filing for your ERC.


It's estimated that roughly 85% of companies, churches, schools, and non-profits have still not received what they are entitled to.


Why? Simply put, they do not know about the program.


The Employee Retention Credit (ERC) allocation was provided as part of the CARES Act when passed by Congress in March of 2020. This federal program was created to help assist in recovering from the financial impact of the pandemic for keeping W2 employees on their payroll during 2020 and 2021. It affords an opportunity to claim a portion of their payroll to be refunded back to them in the form of a check; up to $26k per W2 employee.

 

It is separate from the Paycheck Protection Program (PPP) and is a refundable tax credit paid by the IRS. It is not a loan and does not need to be paid back and if you did receive PPP, you can now also claim your ERC Credit.

 

The ERC is quite complex, and even overwhelming to non-profits, schools, business owners, and tax professionals alike. The guidelines are over 200 pages long and have changed many

times. In fact, if you checked your eligibility status in the past and were told you do not qualify, you may now be eligible. There are over 14,000 mandates nationwide. 


Simply put, you want to work with a CPA professional who specializes in ERC, understands the rules and not some fly-by-night company. As a CPA with over 35 years’ experience and owning my own tax advisory firm, I have helped both profit and non-profit organizations claim their ERC.

 

While many companies believe they don’t qualify, this could be a very costly mistake. Most industry companies have suffered a more than nominal impact to their operations. More than nominal is defined as 10% or more. This could apply to a specific segment of your operations, a lack of supplies, adjustments, etc. Declining revenue is not a sole factor in eligibility.

Don't Wait to Get Your Marriage-Based Green Card!

The Biden Administration announced that marriage-based Green Card interviews are waived under the following circumstance:

  • The Green Card application is filed in the United States at a USCIS Service Center.
  • The filing is successful.

This policy follows the logic – that has been obvious to most of us for a LONG time – that if everything is in order and checks out at the Service Center, then the foreign-born spouse is eligible for a Green Card. The interview is unnecessary. 

 

Scheduling an interview for marriage-based Green Cards can take up to six months. For those in the United States, waiver of the interview can cut the wait time to get your Green Card nearly in half. 

 

Not to mention interviews are stressful and can make even the most legitimate couple seem suspicious. Questions like, "How many people were at your wedding?" or, "where did you go on your first date?" or, "what time did you leave your wedding reception?" or even, "who does the housework and what day does your garbage get picked up?" can fail to jog anyone's memory, especially under stress. AND especially if the couple is separated. Who really does the housework? Questions can be – and often are – subjective. Jump on this opportunity to avoid the whole situation. 

 
Since this is an Administration policy and not a law, now is the time to act to save time, stress, and the possibility of having your Green Card rejected. There is no guarantee that this policy will carry over come 2025.
